Privacy Statement
This Privacy Statement (“Statement”) is for the benefit of visitors and subscribers
to the SuperBuild™ online construction management service (the “Service”). Maintaining
the privacy of visitor and subscriber data is important to SuperBuild. This Statement
sets forth SuperBuild’s data collection, maintenance, and distribution practices.
SuperBuild reserves the right to change this Statement, but will provide notice
of any material changes at least thirty (30) days prior to their effective date.
We require persons who want to use the functionality of the Service to register
and subscribe for it. A person who registers for the Service is a “subscriber”.
Each individual who is issued a username and password is a “user”. For purposes
of this Statement, the terms subscriber and user are treated as the same. Persons
who access the Service site and do not register are “visitors”. Use of the Service
by subscribers is governed by this Statement and the separate Master Subscription
Agreement.
Collected Information
We do not collect personally identifiable information from visitors.
Registration requires the subscriber to give us contact information such as a name,
company name, address, phone number, and e-mail address, and billing information,
such as billing name and address, credit card number, and the number of users within
the organization that will be using the Service. We may also ask for additional
personal information, such as a job title, department name, fax number, or additional
company information, such as annual revenues, number of employees, or industry.
Subscribers can opt out of providing the additional information by not entering
it when asked. Subscribers can update or remove their personal information at any
time by logging into the Service and editing their personal profile. Subscribers
can view their updated profile to confirm that their changes have been made.
SuperBuild uses the registration information to set up the Service for subscribers.
In particular, subscribers are asked to provide an email address so they may be
issued a username and password. We may also use the information to contact subscribers
to further discuss subscriber interest in our company, the Service that we provide,
and to send information regarding our company or partners, such as promotions and
events. Subscribers may be invited to receive an email newsletter by providing an
email address. Subscriber email addresses and any personal subscriber information
will not be distributed or shared with third parties. Subscribers can opt out of
receiving promotional and marketing information from us at any time by sending an
email to support@SuperBuild.com. We may also email information regarding updates
to the Service or company. Again, email will not be distributed or shared and subscribers
can opt out of receiving any communication by emailing support@SuperBuild.com.
Except as we explicitly state at the time we request information, or as provided
for in the Master Subscription Agreement, we do not disclose the information subscribers
enter in the Service to third parties. All financial and billing information we
collect through the Service is used solely for billing purposes, and not for marketing
or promotional purposes. SuperBuild uses a third-party intermediary to manage the
credit card processing. This intermediary is solely a link in the distribution chain,
and is not permitted to store, retain, or use the information provided, except for
the sole purpose of credit card processing. Other third parties, such as content
providers, may provide content on the Web Site but they are not permitted to collect
any information nor does SuperBuild share user information with these parties.
Subscribers are required to store business data through the Service when using its
functionality (“Data”). SuperBuild will not review, share, distribute, print, or
reference such Data except as provided in the Master Subscription Agreement, or
as may be required by law. Individual records may at times be viewed or accessed
only for the purpose of resolving a problem, support issue, or suspected violation
of the Master Subscription Agreement, or as may be required by law. Of course, subscribers
are responsible for maintaining the confidentiality and security of their username
and password.
SuperBuild may also collect network and other information from visitors to and subscribers
of the Service, such as Internet addresses. This information is logged to help diagnose
technical problems, and to help improve the quality of the Service. We may also
track and analyze non-identifying and aggregate usage and volume statistical information
from our visitors and subscribers and provide such information to third parties.
If a user elects to use our referral service for informing a friend about our site,
we ask them for the friend's name and email address. SuperBuild will automatically
send the friend a one-time email inviting them to visit the site. SuperBuild does
not store this information.
Cookies
When visitors and subscribers interact with the SuperBuild Website we strive
to make that experience easy and efficient. When any person accesses our Service
site, the SuperBuild Web server sends a cookie to the client computer. Cookies are
files that Web browsers place on a computer's hard drive and are used to tell us
whether visitors and subscribers have visited the Site previously.
Cookies alone do not identify a visitor personally. They merely recognize a browser.
Unless a visitor chooses to identify himself to SuperBuild by registering for the
Service, the visitor remains anonymous to SuperBuild. Cookies are of two types:
session and persistent. Session cookies exist only during an online session. They
are not stored on a computer when the browser software is closed or the computer
turned off. Persistent cookies remain on a computer after the browser is closed
or the computer turned off. They include such information as a unique identifier
for the client computer’s browser.
SuperBuild uses session cookies containing encrypted information to allow the system
to uniquely identify subscribers while they are logged in. This information allows
SuperBuild to process online transactions and requests. Session cookies help us
make sure subscribers are who they say they are after they have logged in. These
cookies are required in using the Service. SuperBuild does not make a practice of
using persistent cookies to identify Service subscribers or prior visitors. If SuperBuild
determines to use persistent cookies, SuperBuild will be especially careful about
the security and confidentiality of the information stored in persistent cookies.
For example, SuperBuild does not store account numbers or passwords in persistent
cookies. Subscribers who disable their Web browsers' ability to accept cookies will
be able to browse our Service Web pages but will not be able to use the application
functionality.
Third Party Cookies: SuperBuild may from time to time engage third parties to track
and analyze general usage and volume statistical information from visitors and subscribers
as an aid to improving performance of the Service. Third parties may use the cookies
to help track visitor and subscriber behavior. Such cookies will not be used to
associate individual Service visitors and subscribers with any personally identifiable
information. All data collected by such third parties for SuperBuild is only used
for analysis of Service usage and performance.
Third-Party Sites
The Service may contain links to other Web sites. SuperBuild is not responsible
for the privacy practices or the content of other Web sites. Visitors and subscribers
will need to check the policy statements of other Web sites to determine their policies.
Visitors and Subscribers who access a linked site may be disclosing their private
information. It is the responsibility of the user to keep such information private
and confidential.
Security
The Service includes security features to help protect against the loss, misuse,
and alteration of the Data. When our Service is accessed using Microsoft Internet
Explorer versions 6.0 or higher or Mozilla1+ (Firefox), Secure Socket Layer (SSL)
technology protects information using both server authentication and data encryption
to help ensure that Data is safe and secure. SuperBuild also implements an advanced
security method based on dynamic data and encoded session identifications, and hosts
the Site in a secure server environment that uses a firewall and other advanced
technology to prevent interference or access from intruders. Finally, SuperBuild
provides unique user names and passwords that must be entered each time a subscriber
accesses the Service. These safeguards help prevent unauthorized access, maintain
data accuracy, and ensure the appropriate use of Data.
Opt-Out Policy
SuperBuild offers subscribers a means to choose how SuperBuild uses some of
the information they provide. Subscribers may change their minds about their options
for receiving information from SuperBuild at any time after registering for the
Service. Subscribers may change their user profile or send SuperBuild a request
specifying their new choice.
Correcting and Updating Information
If subscribers need to update or change registration information they may do
so by editing their user profile.
